GENERAL TERMS AND CONDITIONS OF ONLINE SALES
General Provisions
These terms and conditions apply exclusively between the company DELTA SERVICE S.r.l., with registered office at SS. 18, No. 4 Loc. Fosso Pioppo - 84091 Battipaglia (SA), VAT No. 05045500658, and any person making online purchases on the website deltaservicedieselengines.com, hereinafter referred to as the "CLIENT." These terms and conditions are subject to change, and the publication date on the website is equivalent to the effective date.
These conditions govern purchases made on deltaservicedieselengines.com in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003 on electronic commerce).
ARTICLE 1 - Subject of the Contract
Under these General Terms and Conditions of Sale, DELTA SERVICE S.r.l. sells and the CLIENT purchases tangible movable goods indicated and offered for sale on deltaservicedieselengines.com. The contract is concluded exclusively through the internet by accessing the website deltaservicedieselengines.com and placing an order following the procedure provided by the site.
Before confirming the order, the CLIENT commits to reviewing these General Terms and Conditions of Sale, particularly the pre-contractual information provided by DELTA SERVICE S.r.l., and to accepting them by checking the appropriate box.
ARTICLE 2 - Pre-contractual Information for the Consumer (Art. 49 of Legislative Decree 206/2005)
Before concluding the purchase contract, the CLIENT reviews the characteristics of the goods as illustrated in the individual product sheets at the time of selection. Before the finalization of the contract and before confirming the order with "payment obligation," the CLIENT is informed of:
- The total price of the goods, including taxes, along with shipping costs and any other expenses;
- Accepted payment methods;
- The delivery timeframe committed by DELTA SERVICE S.r.l.;
- The conditions, terms, and procedures for exercising the right of withdrawal (Art. 6 of these conditions), as well as the standard withdrawal form (Annex I, Part B of Legislative Decree 21/2014);
- Any costs the CLIENT will incur for returning goods in case of withdrawal;
- The existence of a legal warranty of conformity for purchased goods;
- Any after-sales services and commercial warranties provided by DELTA SERVICE S.r.l..
At any time before the conclusion of the contract, the CLIENT may access the information related to DELTA SERVICE S.r.l., including its geographical address, telephone and fax number, and email address, as follows:

ARTICLE 3 - Conclusion and Effectiveness of the Contract
The sales contract is considered concluded when DELTA SERVICE S.r.l. sends the CLIENT an email confirming the order. The email contains:
- The CLIENT's details and order number;
- The price of the purchased goods;
- Shipping costs;
- The delivery address;
- A link to print and archive these terms and conditions.
The CLIENT must verify the accuracy of their personal data and promptly notify DELTA SERVICE S.r.l. of any corrections. DELTA SERVICE S.r.l. endeavors to describe and present the items for sale on the site as accurately as possible. However, minor errors, inaccuracies, or differences between the site and the actual product may occur. The product images on deltaservicedieselengines.com are for representation only and are not legally binding.
DELTA SERVICE S.r.l. commits to delivering the goods within 30 days from the date of the order confirmation email.
ARTICLE 4 - Product Availability
Product availability refers to the actual availability at the time the CLIENT places an order. However, this availability is purely indicative because multiple users may purchase the same product simultaneously. In such cases, even after sending the order confirmation email, the product may become unavailable. If this occurs, the CLIENT will be notified via email with restocking times. If the CLIENT requests order cancellation, DELTA SERVICE S.r.l. will refund the paid amount within 14 days from the receipt of the cancellation request.
ARTICLE 5 - Payment Methods
Payments by the CLIENT can be made only through the payment methods listed on deltaservicedieselengines.com, namely:
- Credit Card;
- Bank Transfer;
- PayPal.
Orders will be processed and shipped only upon successful payment of the full order amount. Payment-related communications and data are transmitted over secure, encrypted connections. Credit card security is guaranteed via VBV (Verified by VISA) and SCM (Security Code Mastercard).
ARTICLE 6 - Prices
All product prices listed on deltaservicedieselengines.com are in Euros (€) and include VAT. Shipping costs are not included in the purchase price and are calculated at checkout before payment confirmation.
DELTA SERVICE S.r.l. reserves the right to change prices at any time. However, the goods will be billed based on the prices indicated on the website at the time of order creation, as confirmed in the order confirmation email. If a technical, manual, or any other error results in a significant price discrepancy, DELTA SERVICE S.r.l. reserves the right to cancel the order and refund the CLIENT within 14 days of the cancellation request.
ARTICLE 7 - Right of Withdrawal
The CLIENT has the right to withdraw from the purchase within 14 days of receiving the products, without any penalty or need for justification. To exercise this right, the CLIENT must notify DELTA SERVICE S.r.l. through an explicit statement sent by:

The return must be made within 14 days from the withdrawal notice. The CLIENT is responsible for return shipping costs. The products must be returned in their original, complete, and undamaged packaging.
Refunds will be processed within 14 days of receiving the returned goods, using the same payment method as the original transaction.
ARTICLE 8 - Legal Warranty of Conformity
If a product does not conform to the order or is defective, the CLIENT has the right to have it repaired or replaced at no cost. The defect must be reported within 2 years from delivery and within 2 months from discovery.
ARTICLE 9 - Delivery Methods
Orders are shipped only within Italy and the Republic of San Marino via GLS courier. Delivery times vary from 24 to 48 hours depending on the destination.
ARTICLE 10 - Liability
DELTA SERVICE S.r.l. is not responsible for delays due to force majeure, internet malfunctions, or unforeseen circumstances.
ARTICLE 11 - Applicable Law and Jurisdiction
These terms and conditions are governed by Italian law. Any disputes will be subject to the jurisdiction of the CLIENT's place of residence within Italy. Optional mediation procedures may also be pursued under Legislative Decree 28/2010.
